Affiliated Managers 3Q earnings up nearly 37 pct.

BOSTON (AP) ? Asset manager Affiliated Managers Group Inc. said Wednesday its third-quarter earnings jumped nearly 37 percent, boosted by strong investment performance.

The company reported net income of $54.9 million, or $1.04 per share, in the July-September quarter, up from $40.1 million, or 76 cents per share, in the third quarter of 2011.

Third-quarter revenue rose 12.9 percent, to $467.3 million from $413.8 million a year earlier.

Excluding one-time costs, economic earnings per share were $1.91, up from $1.55 in last year's third quarter.

Analysts surveyed by FactSet forecast earnings per share of $1.87 on revenue of $486.4 million, on average.

Economic earnings exclude some expenses, such as amortization and deferred taxes related to intangible assets. Affiliated Managers Group considers economic earnings a key measure of performance because it represents operating performance before certain expenses tied to acquisitions of interests in affiliated management firms.

The company, based in Prides Crossing, Mass., said net client cash flows for the latest quarter were $10.9 billion. Assets under management as of Sept. 30 were about $416 billion, up from around $385 billion at the end of June.

Affiliated Managers said it continues to benefit from demand from global institutional clients for emerging markets stocks and alternative investments, which generate about 70 percent of its earnings.

Shares of Affiliated Managers rose $1.31 to $125.45 in afternoon trading.

The Sayre family bought their vacation home in Seaview, Washington twelve years ago. This one bedroom cottage is blocks from the waterfront in a sleepy coastal town just 3 hours south of Seattle. Now spending most of their time up north in the city, the Sayres have opened their home to guests and family friends who need a quiet getaway. Welcome to the Shoebox Inn.

When my friend Mike emailed me about his family vacation home, I realized what an opportunity it would be to show how compact living can be comfortable and functional, even when sleeping up to 6 people. Carol expressed her desire to stay thrifty, cozy and welcoming in the design of The Shoebox Inn. She feels that when designing a home it is most important to have "things around that you love but that also function efficiently. Make sure there are comfortable places to read with adequate lighting. That's what makes me feel most at home in a dwelling."

This cozy small town was like the set of movie; everyone seems to know each other in town, everything is locally grown and supported? and there is no need for glitzy state-of-the-art anything. Most specifically, Carol says the 1957 Zenith Range holds high significance in the home. "I'm sure it was the height of modern luxury and convenience when it was first made. It reigns like the "homecoming queen" in the kitchen, setting just the right mood."

With a home in Seattle and their two sons in Los Angeles, there were many influences and ideas that came together throughout the years in this vacation home. "Both of our sons live in Los Angeles. One works in the film industry and the other in design. I think there is a little bit of a Hollywood set "feel" about "The Shoebox Inn." Because of the great movie tradition of Los Angeles, there probably are few homes that aren't influenced in some way by the culture of Los Angeles, either directly or indirectly."

Our Style: Vintage Thrift Store Chic.

Inspiration: My Grandma Betty, a woman who had both an atheistic eye and a good sense of practicality.

Favorite Element: The nod to the 50's feel of the kitchen.

Biggest Challenge: Sleeping the whole family in such a small space. There was only one bedroom, so we had to think like we were on a ship. We managed to get two sets of bunks and a full size bed in the room by taking out the only closet and filling in the doorway from the bedroom to the kitchen. We replaced the lost closet space with storage baskets under the bunks. The new wall also gave us a place to put a dining room table in the kitchen.

What Friends Say: We all like to get away and one of my favorite things about owning the house is letting our friends stay. It feels good when they express appreciation for the look of the house, but we love hearing about the fun things they did in the area even more. This corner of the Northwest Washington Coast has really managed to stay unspoiled ? no outlet malls, casinos or massive resorts blot the landscape. Thus the Long Beach Peninsula has the feeling of yesteryear about it. I think our friends appreciate that as much as anything.

Biggest Embarrassment: Booking two friends to stay at "The Shoebox Inn" for the same weekend.

Proudest DIY: Making built-ins so that a 500 square foot house could work for a family of six. I also like the black and white diamond painted porch. My friend Cynthia helped paint it. It was a bit time consuming, but it greatly helped the street appeal of the cottage.

Biggest Indulgence: We have a few prints, but try to buy original art as much as possible. We've made a game of collecting art for the beach house by putting ourselves on a thrift store budget. The cottage is cute and cozy, but because nothing is overly valuable, we don't worry about what might happen to the stuff when others stay. With the exception of one picture, we spent no more than $35 on any one piece of artwork in the cottage. Sometimes I'll get a painting at a second hand store and frame it with some great frame from a garage sale to improve the look. A good frame can make a silk purse out of a sow's ear.

Best Advice: When decorating a vacation house, put your guests above your possessions. Be willing to share your home. It only increases your joy of ownership.

Dream Sources: My primary home, which has a different feel than the beach house, has an old world European feel ? perhaps even monastic in places. I love the inspiration of many French and English magazines, especially old ones from the 90's, but I try to incorporate the looks in a uniquely American way.

Heat get rings, then win over Celtics, 120-107

MIAMI (AP) ? LeBron James got cramps, Ray Allen was snubbed and Dwyane Wade was steaming.

None of that spoiled the Miami Heat mood on ring night.

Wade scored 29 points, James finished 26 points and 10 rebounds while missing much of the second half because of cramps in both legs, and the reigning NBA champion Heat beat the Boston Celtics 120-107 on Tuesday night in the season opener for both teams.

There were actual fireworks before the game to close the ceremony where the Heat got their championship rings and raised their title banner. There also were plenty of figurative fireworks late, first with Boston almost digging out of a 19-point hole and, after the outcome was decided, Rajon Rondo flagrantly fouling Wade by wrapping his arms around his neck on a drive.

In the end, though, the first Celtics-Heat matchup of this season was like the final one of last season ? with Miami winning.

"It was good to cap this night off with a win," Heat coach Erik Spoelstra said. "It was an emotional time for all of us in our organization."

Even for the newcomers, like Allen. He scored 19 points ? needing only seven field goal attempts ? in his first game with Miami since leaving Boston over the summer. Chris Bosh had 19 points and 10 rebounds for Miami.

Allen got chants from the Heat crowd, which is nothing new. Except this time, they were positive.

"Never thought I'd hear that here," Allen said.

Paul Pierce scored 23 points, Rondo finished with 20 points and 13 assists, and Leandro Barbosa scored 16 for Boston. The Celtics, who lost to the Heat in last season's Eastern Conference finals, were not on the court for the ring ceremony.

They almost wrecked the festive mood with a late comeback.

An 11-2 run late in the fourth quarter got Boston within 111-107 on Courtney Lee's layup with 2:09 left. That was the last Celtics' hurrah ? Bosh scored the game's next seven points, sealing it for Miami.

"I thought they were the aggressor the whole game," Celtics coach Doc Rivers said. "They got on the floor where they wanted to get on the floor. They took us out of stuff that they wanted to."

Rashard Lewis scored 10 points for Miami, which held on even while James, last season's MVP of both the regular season and NBA Finals, was in the locker room for the second time because of the cramps, first in his right leg and then his left.

"It's not an all-the-time thing," James said. "I'm not too worried about it."

The Heat got their championship rings from owner Micky Arison before the game, then watched the banner get hoisted to the rafters. More emotion came late, when Wade drove past Rondo ? and the Celtics guard grabbed Wade around the neck. Wade appeared as though he was ready to throw the ball at Rondo in retaliation, and stopped himself.

"I thought he hooked me," Rondo said.

Wade had a different opinion.

"It was a punk play by him," Wade said. "The league will take care of it. He clotheslined me, with two hands."

So Rondo raised eyebrows by putting hands on Wade. Kevin Garnett made news by not offering his hand to Allen.

As Allen entered the game for the first time, he trotted toward the Boston bench, exchanging a handshake, embrace and a few words with Rivers, who hasn't hidden his displeasure about his former shooting guard's decision to sign with Miami and didn't sound certain before the game how he would react when he saw Allen in Miami colors. Allen then briskly shook hands with a few assistant coaches.

But when Allen tried to engage Garnett, the mutual pleasantries ended. Allen tapped Garnett on the shoulder as he sat on the Boston bench; Garnett didn't even flinch, staring straight ahead, refusing to acknowledge the gesture in any way.

"I was just trying to focus as much as I could. I am such an intense person," Garnett said. "It was a blank. Obviously he's on the other side. It's time to play the game, man."

Allen didn't seem flustered. His first shot in a Miami uniform was ? what else? ? a corner 3-pointer, which swished.

"He was by himself in the corner," Rivers said. "You'd think we'd know better."

Miami controlled much of the first half, taking a 62-54 lead after James went by Pierce and Garnett for a two-handed dunk and yell for the crowd.

The first Heat angst of the season came in the third quarter, when James walked slowly to the bench after a timeout with 4:40 remaining, favoring his right leg and then headed out the tunnel toward the locker room.

When he left, the Miami lead was 79-70.

When he returned to open the fourth quarter, the lead was 93-76. The Heat scored the final eight points of the third, with Bosh, Allen, Mario Chalmers and Lewis all scoring in the final 2:17 to give the Heat their biggest lead of the game.

James ? who was dealing with a cramping issue, like he experienced at times in last season's NBA Finals ? opened the fourth quarter with a jumper to extend the run to 10-0, and Miami seemed well on its way. But he returned to the locker room a short time later, the cramps having flared up again.

"Once you start cramping, there's nothing you can do about it," James said.

Jeff Green, who had season-ending surgery for an aortic aneurysm last January, played in a game that counts for the first time since May 11, 2011 ? also in Miami, when the Heat ousted the Celtics from that season's playoffs. Green finished with three points in 23 minutes.

NOTES: Wade passed the 15,000-point mark for his career early in the second quarter, becoming the 123rd player in NBA history to reach that mark, according to STATS LLC. ... Rondo had at least 10 assists for the 25th straight regular-season game. ... The Celtics allowed 62 points in the first half; they gave up 62 or more only seven times in 379 regular-season and playoff games over the past four seasons. ... The home of U.S. Rep. Bob Turner was one of the casualties of the fire that engulfed Breezy Point, Queens amid Hurricane Sandy, Crain?s reported.

A Washington spokesman for Turner, a Republican who represents parts of Queens and Brooklyn ? Anthony Weiner?s former district ? confirmed that Turner?s primary residence burned down in the fire, which consumed an estimated 80 homes late yesterday and early today, Crain?s said.

While Turner remained at his house until late in the storm, he and his family made it out of the area safely, a spokesperson told Crain?s.

Mike Long, a neighbor and chairman of the Conservative Party of New York, told Crain?s that homes in the area ?aren?t even burnt, they?re completely gone.? Long?s home was destroyed, but his family also made it to safety, he told Crain?s. [Crain's] ?Guelda Voien

?Man in Moon? created by asteroid impact the size of Austria

The "Man in the Moon" may have been created by a giant asteroid (National Institute of Advanced Industrial Science??The famous flattened image across the surface of the moon, long dubbed the "Man in the Moon," appears to have been created by a giant asteroid the size of Austria.

A new study published in the British journal Nature Geoscience says the flattened, 1,800-mile-wide section of the moon's Procellarum basin was caused after the large asteroid crashed into the moon's surface.

"The nearside and farside of the Moon are compositionally distinct," reads the introduction to the study. "The detection of low-calcium pyroxene around large impact basins suggests that the huge Procellarum basin on the nearside may be an ancient impact structure and a relic scar of the violent collision that produced the lunar dichotomy."

Scientists at the National Institute of Advanced Industrial Science and Technology studied the distribution of minerals on the moon's surface using data collected by Japanese moon exploration orbiters, the Asahi Shimbun reported.

The size of the asteroid is estimated to have been 180 miles in diameter, hitting the moon's surface 3.9 billion years ago.

"The latest study explains why the moon's two sides are so different," said Junichi Watanabe, a professor of astronomy at the National Astronomical Observatory of Japan. "It helps unravel the mystery of the moon's history."

Mexico City Journal: Axolotls, Mexico?s Mythical Salamander, Struggle in the Wild

Biologists are trying to preserve the axolotl, a creature that is one of the few natural links Mexicans still have to the Aztecs.

MEXICO CITY ? Aztec legend has it that the first axolotl, the feathery-gilled salamander that once swarmed through the ancient lakes of this city, was a god who changed form to elude sacrifice.

But what remains of its habitat today ? a polluted network of canals choked with hungry fish imported from another continent ? may prove to be an inescapable threat.

?They are about to go extinct,? said Sandra Balderas Arias, a biologist at the National Autonomous University of Mexico working to conserve axolotls in the wild.

The loss of this salamander in its habitat would extinguish one of the few natural links Mexicans still have with the city that the Aztecs built on islands in a network of vast mountain lakes. Its extinction in the wild could also erase clues for scientists studying its mystifying traits.

Despite their precarious future in freshwater, axolotls (pronounced axo-LO-tuhls) have long flourished in aquariums. They have been bred successfully behind glass over the past century, raised as exotic pets or as laboratory specimens for scientists investigating their extraordinary ability to regrow a severed limb or tail.

The Mexican axolotl is an odd-looking salamander with a flat head and spiked feet, unusual because it often spends its entire life in the so-called larval stage, like a tadpole, without ever moving to land. ?It grows and grows in the same shape, and has the capacity to reproduce,? said the biologist Armando Tovar Garza. ?We don?t really know why it doesn?t change.?

Its gaze seems to captivate as its gills slowly beat. In Julio Cort?zar?s short story ?Axolotl,? the narrator is transfixed ? ?I stayed watching them for an hour and left, unable to think of anything else? ? and experiences his own metamorphosis.

The Aztecs and their descendants consumed axolotls as part of their diet, and the amphibians are still stirred into a syrup as a folk remedy for respiratory ailments.

But in their only home, the canals of Xochimilco in the far south of the city, the axolotls? decline has been precipitous. For every 60 of them counted in 1998, researchers could find only one a decade later, according to Luis Zambrano, another biologist at the National Autonomous University of Mexico.

Gliding on a flat-bottomed boat through the canals where the Aztecs once farmed floating gardens, but where cinder block houses now dump their waste and students toss their beer cans during parties, Mr. Tovar described the threats. ?The axolotl is suffering on two fronts,? he said, as pounding music and the smell of sewage filled the air. ?One is the water quality. It?s not improving.?

Then, as dimples appeared on the still surface of the canal, like raindrops before a deluge, another researcher leaned over and the axolotl?s second challenge became evident. ?See how the water is moving? All of those circles?? asked the researcher, Leonardo Sastre Baez, who monitors fishing. ?Those are the tilapias.?

That resilient fish was introduced over 20 years ago, along with carp, in an effort to support Xochimilco?s fishermen. ?The government thought, ?If people can?t work, at least they can eat,??? Mr. Sastre said. But the tilapias reproduce faster than they can be caught, and they feed voraciously on the plants where the axolotls lay their eggs.

Mexicans? taste for axolotls has endured, generating some strong reactions from Europeans over the years. The naturalist and explorer Alexander von Humboldt wrote in the 19th century that the Mexicans he observed lived ?in great want, compelled to feed on roots of aquatic plants, insects and a problematical reptile called axolotl.?

Others would disagree with the interpretation.

?Have you ever eaten frogs?? asked Roberto Altamirano, president of the fishermen?s association, who ate axolotls as a child and is now working to save them. ?Well, that?s what it tastes like. Somewhere between fish and chicken.?

Final 2012 production model to be auctioned for the American Heart Association and previews 2013 COPO Camaro program

LAS VEGAS ? The last 2012 COPO Camaro debuted today at the SEMA Show, in Las Vegas, and it's headed to the auction block. Chevrolet will sell the Inferno Orange Metallic convertible race car at the 2013 Barrett-Jackson Scottsdale Auction, in January, to benefit the American Heart Association.

A few factors should make this supercharged drop-top more enticing to bidders:

It's one of 69 COPO Camaro race cars built by Chevrolet for 2012 ? and it's car number 69 of the sequenced production matched to its engine
It's one of only two convertibles built ? the other being car number 68 (which has been set aside by Chevrolet and isn't planned for public sale)
It's one of 20 cars built with the 327 engine and 4.0L supercharger
It's the only '12 COPO Camaro painted Inferno Orange Metallic ? and features additional custom graphics and special interior trim
It's the only example built with a Turbo 400 three-speed automatic transmission.
The top is fully operational, although it must be up when racing, per NHRA rules.

"The COPO Camaro program has been a special program and there's not a better way to close out the 2012 racing season than with the final ? and most unique ? one of the production run," said Jim Campbell, GM U.S. vice president of Performance Vehicles and Motorsports. "Chevrolet is proud to once again partner with the American Heart Association at Barrett-Jackson for the sale of this COPO Camaro convertible. It will make a great race car or collector vehicle for a lucky bidder, who will be buying a piece of history.

"I am also happy to announce that due to strong customer demand we will produce another run of 69 COPO Camaros for 2013. More than 3,000 hand-raisers expressed interest in buying a COPO after we introduced the car at SEMA last year. We are excited to support these grassroots motorsports enthusiasts in their Stock Eliminator and Super Stock drag racing efforts," said Campbell.

The last 2012 COPO Camaro is powered by the COPO 327 engine that features a 4.0L Whipple supercharger, for an NHRA-certified output of 550 horsepower. The 2012 COPO Camaros were also available with a supercharged 327 engine featuring a smaller, 2.9-liter supercharger and a naturally aspirated 427 engine. All of the engines were assembled at GM's unique Performance Build Center, in Wixom, Mich., where the LS7 and LS9 production engines for the Corvette Z06 and Corvette ZR1, respectively, are built, along with select Chevrolet Performance crate engines.

All COPO Camaro were built by hand starting with hardware from the Oshawa assembly plant that manufactures regular-production Camaros, including the same "body in white" body shells racers can purchase from Chevrolet Performance to build their own dedicated race car. Each was fitted with an NHRA-approved roll cage and other safety equipment, along with racing chassis and suspension components ? including a unique solid rear axle system in place of a regular-production Camaro's independent rear axle. The cars rolled off the line wearing lightweight Bogart racing wheels and Hoosier racing tires.

Although only 69 production models were built for 2012, many of the fundamental components used to create the cars ? including all of the hand-assembled racing engines ? are available from Chevrolet Performance and the licensed aftermarket manufacturers who supplied them. They are listed in a special COPO section of the new 2013 Chevrolet Performance catalog, which debuted at the SEMA Show and is now available from Chevrolet dealers or by ordering online at chevroletperformance.com.

Also available from Chevrolet Performance is a "build book," which provides an overview of the cars' assembly process.

"Not everyone could purchase a COPO Camaro production model in 2012, but we are making it easier to build one from the ground up," said Campbell. "From the body in white to the COPO crate engines, we offer the parts and a build book to replicate these quick race cars in your garage."

Between the 25th and 29th of October 2012 17,559 people, presumably members of the MMD monitor panel completed a presumably private survey. No further demographics were provided.

I?m sort-of thinking about a Nexus 7; it?s nice and cheap, and pretty good according to reviews by friends. I?m interested to see if the Japanese manufacturers exit the consumer tablet market; Sony at least offer a different design than just a slab, and I was disappointed to see that the Panasonic Eluga Live tablet doesn?t even merit a mention, although the 90,000 yen price tag might have something to do with it?

    What do seniors spend on grandchildren?

    We spend too much on our three, but ours don't ask for expensive items like some kids do. I know we'll have to help out with college later on if they are going, so we try not to go overboard.     Dragon ship back on Earth after space station trip

    CAPE CANAVERAL, Fla. (AP) ? An unmanned Dragon freighter carrying a stash of precious medical samples from the International Space Station parachuted into the Pacific Ocean on Sunday, completing the first official shipment under a billion-dollar contract with NASA.

    The California-based SpaceX company successfully guided the Dragon down from orbit to a splashdown a few hundred miles off the Baja California coast.

    "This historic mission signifies the restoration of America's ability to deliver and return critical space station cargo," Elon Musk, the billionaire founder and head of SpaceX, said in a statement.

    NASA Administrator Charles Bolden praised the "American ingenuity" that made the endeavor possible.

    Several hours earlier, astronauts aboard the International Space Station used a giant robot arm to release the commercial cargo ship 255 miles up. SpaceX provided updates of the journey back to Earth via Twitter.

    The supply ship brought back nearly 2,000 pounds of science experiments and old station equipment. Perhaps the most eagerly awaited cargo is nearly 500 frozen samples of blood and urine collected by station astronauts over the past year.

    The Dragon is the only delivery ship capable of returning items, now that NASA's shuttles are retired to museums. Atlantis made the last shuttle haul to and from the station in July 2011.

    SpaceX ? more formally Space Exploration Technologies Corp. ? launched the capsule three weeks ago from Cape Canaveral, full of groceries, clothes and other station supplies. Ice cream as well as fresh apples were especially appreciated by the station residents, now back up to a full crew of six.

    It's the second Dragon to return from the orbiting lab; the first mission in May was a flight demo. This flight is the first of 12 deliveries under a $1.6 billion contract with NASA.

    "It was nice while she was on board," space station commander Sunita Williams said as the Dragon backed away. "We tamed her, took her home and, literally and figuratively, there's a piece of us on that spacecraft going home to Earth."

    She added to the SpaceX flight controllers in Hawthorne, Calif.: "Congratulations Hawthorne and thank you for her."

    The Dragon will be retrieved from the Pacific and loaded onto a 100-foot boat that will haul it to Los Angeles. From there, it will be transported to McGregor, Texas.

    The medical samples will be removed as quickly as possible, and turned over to NASA within 48 hours of splashdown, according to SpaceX. Everything else will wait for unloading in McGregor.

    A Russian supply ship, meanwhile, is set to blast off this week. It burns up upon descent, however, at mission's end. So do the cargo vessels provided by Europe and Japan.

    SpaceX is working to transform its Dragon cargo craft into vessels that American astronauts could fly in another four or five years. Until SpaceX or another U.S. company is able to provide rides, NASA astronauts must rely on Russian rockets to get to and from the space station.

    WASHINGTON (AP) ? Three years ago, the Supreme Court warned there could be constitutional problems with a landmark civil rights law that has opened voting booths to millions of African-Americans. Now, opponents of a key part of the Voting Rights Act are asking the high court to finish off that provision.

    The basic question is whether state and local governments that once boasted of their racial discrimination still can be forced in the 21st century to get federal permission before making changes in the way they hold elections.

    Some of the governments covered ? most of them are in the South ? argue they have turned away from racial discrimination over the years. But Congress and lower courts that have looked at recent challenges to the law concluded that a history of discrimination and more recent efforts to harm minority voters justify continuing federal oversight.

    The Supreme Court took no action Monday on cases asking it to end the Voting Rights Act's advance approval requirement that has been held up as a crown jewel of the civil rights era.

    The justices sidestepped this very issue in a case from Texas in 2009. In an opinion joined by eight justices, Chief Justice John Roberts wrote then that the issue of advance approval "is a difficult constitutional question we do not answer today."

    Since then, Congress has not addressed potential problems identified by the court. Meanwhile, the law's opponents sensed its vulnerability and filed several new lawsuits.

    The advance approval, or preclearance requirement, was adopted in the Voting Rights Act in 1965 to give federal officials a potent tool to defeat persistent efforts to keep blacks from voting.

    The provision was a huge success, and Congress periodically has renewed it over the years. The most recent occasion was in 2006, when a Republican-led Congress overwhelmingly approved and President George W. Bush signed a 25-year extension.

    The requirement currently applies to the states of Alabama, Alaska, Arizona, Georgia, Louisiana, Mississippi, South Carolina, Texas and Virginia. It also covers certain counties in California, Florida, New York, North Carolina and South Dakota, and some local jurisdictions in Michigan and New Hampshire. Coverage has been triggered by past discrimination not only against blacks, but also against American Indians, Asian-Americans, Alaskan Natives and Hispanics.

    Before these locations can change their voting rules, they must get approval either from the U.S. Justice Department's civil rights division or from the federal district court in Washington that the new rules won't discriminate.

    Congress compiled a 15,000-page record and documented hundreds of instances of apparent voting discrimination in the states covered by the law dating to 1982, the last time it had been extended.

    Among the incidents in the congressional record:

    ?In 1998, Webster County, Ga., tried to reduce the black population in several school board districts after citizens elected a majority-black school board for the first time.

    ?In 2001, Kilmichael, Miss., canceled an election when a large number of African-American candidates sought local office following 2000 census results that showed blacks had become the majority in the city.

    ?In 2004, Waller County, Texas, sought to limit early voting near a historically black college and threatened to prosecute students for illegal voting after two black students said they would run for office.

    But in 2009, Roberts indicated the court was troubled about the ongoing need for a law in the face of dramatically improved conditions, including increased minority voter registration and turnout rates. Roberts attributed part of the change to the law itself. "Past success alone, however, is not adequate justification to retain the preclearance requirements," he said.

    He also raised concern that the formula by which states are covered relies on data that is now 40 years old. By some measures, states covered by the law were outperforming some that were not.

    Jurisdictions required to obtain preclearance were chosen based on whether they had a test restricting the opportunity to register or vote and whether they had a voter registration or turnout rate below 50 percent.

    In the federal court of appeals in the District of Columbia, Circuit Judge Stephen Williams objected that the law specifies that these criteria are measured by what happened in elections several decades ago. But writing for a majority that upheld preclearance, Circuit Judge David Tatel said the question is not whether old data is being used, but whether it helps identify jurisdictions with the worst discrimination problems. "If it does, then even though the formula rests on decades-old factors, the statute is rational," Tatel said.

    Shelby County, Ala., a well-to-do, mostly white bedroom community near Birmingham, adopted Roberts' arguments in its effort to have the voting rights provision declared unconstitutional, but lost in the lower courts. The county's appeal is among those being weighed by the high court.

    Yet just a few years earlier, a city of nearly 12,000 people in Shelby County defied the voting rights law and prompted the intervention of the Bush Justice Department.

    Ernest Montgomery became the only black member of the five-person Calera City Council in 2004, winning in a district that was almost 71 percent black. The city redrew its district lines in 2006 after new subdivisions and retail developments sprang up in the area Montgomery represented, and the change left Montgomery's District 2 with a population that was only 23 percent black.

    Running against a white opponent in the now mostly white district, Montgomery narrowly lost a re-election bid in 2008. The Justice Department invalidated the election result because the city had failed to obtain advance approval of the new districts.

    A lifelong resident of Calera and a church deacon, the 56-year-old Montgomery said he doesn't know whether discrimination was involved in the redistricting decision six years ago. But, he said, discrimination still exists and the law is still needed.

    "I think things have gotten a lot more leveled out, but we're not to the point we need," he said.
